Chapter III - Members of the Club
Section I - Admission and classification
Article 14
1- The quality of members of SPORTING CLUBE DE PORTUGAL may be acquired as a singular person or collective, in that they have been proposed and satisfy the conditions described in these statutes 2- No admittance in the form of membership can be granted to singular persons or collectives that have contributed to behaviour deemed indignant ('indignos') or discrediting ('desprestígio') to any sporting institution, cultural our recreational or which, by their conduct, is not of recognised reputation for being eligible members of SPORTING CLUBE DE PORTUGAL. 3- The admission of collectives of people and their laws and obligations of members, in addition to the restrictions contained in article 2, will be subject to specific regulation, approved by the Board ('Conselho Directivo'), always with observance to the spirit of these statutes.
Article 15
1- The members of SPORTING CLUBE DE PORTUGAL are divided by the following categories: a) Staff ('Efectivos') members; b) Auxiliary members; c) Athlete members. 2- It is permitted, by the General Assembly, the creation of other categories of members, with specification of their rights and duties.
Article 16
Staff members are to be equal to or greater than eighteen years of age, that are integrated, in a permanent and direct manner, in the life of the Club, including contribution to its maintenance and development, and to who, therefore, have the plenitude of rights established in these statutes.
Article 17
1- Auxiliary members of the club are those that, by virtue of age, relationship or kinship do not enjoy the full plenitude of the rights presented in these statutes and do not have all duties of these statutes applicable to them. 2- The category of auxiliary members includes the following subcategories: a) Family - that are descendants of members, that are subscribed before one year of age, and that will benefit from nonobligatory payment of quota, will automatically be, upon reaching six years of age, placed into the subcategory of infant and become subject to the fee the respective quota; b) Infants - those aged less than twelve years of age, not including those in the preceding paragraph, and those referred to in that paragraph when they reach six years of age; c) Juveniles - that are aged between twelve and eighteen years of age inclusive; d) Correspondents - those that, in paying the respective quota, are restricted to a specific objective of an activity of the Club, especially the maintenance and promotion of the solidarity between the elements of the leonina family. 3- Auxiliary members that become staff members will inherit the rights of that category, according to present laws, and will keep their original date of commencement of membership.
Article 18
1 - Athlete members are those that represent SPORTING CLUBE DE PORTUGAL in official competitions, as they are at present, at their request, admitted as members. 2 - The provisions of paragraph 3 in article 17 are applicable to athlete members.
Article 19
1- The number of members does not have other limits other than those derived from conditions of qualification; however, the Board ('Conselho Directivo') decides on all admissions of new members and regulates everything that is seen as necessary for the for the execution of the provisions in this section of the statutes. 2- In case of death of a member, who may have moral interests that require maintenance, the symbolic title, of the subscription of the deceased, continues to be paid by the partner, if living, and the number of subscription becomes the date of the death of the member in question, with indication that respects the wishes of deceased, without prejudice to that number or the living member. 3- The numbering of members is updated during years ending in the number '0' and '5', with correlating replacement of the cards associated. 4- The membership numbers of one to ten however will occur automatically as per vacancy. 5- The membership number three is not be allocated, in the wish of always maintaining the memory of Francisco Stromp.
Section II - Rights and Duties of Members
Article 20
1 - The rights of members are: a) To participate in the General Assemblies ('Assembleias Gerais') of the Club, to present proposals and to engage in discussions and votes; b) To be elected to governing bodies; c) Request the convening of extraordinary General Assemblies, in terms of the present statutes; d) Examine, in statutory terms, the books, accounts and other documents, in the eight days before the establishment of a respective General Assembly; e) Propose the admission of members and to appeal, to the General Assembly, those proposed that the Board ('Conselho Directivo') has rejected; f) Solicit in writing to governing organisations the presentation of useful suggestions for the Club; g) Request that the Board suspend the payment of quotas, with the founding of justified motives for doing so; h) Receive and use the distinctive honours and awards outlined in these statutes; i) Request the dismissal of a member; j) Frequent the social and sporting installations of the Club, and utilise them in harmony with the internal regulations and requirements of those Clubs. 2- The rights enshrined in the provisions a), b), c) and d) of this article, with exception of mere presence in General Assemblies, relative only to staff members in the category with less than twelve months; are in light of the following: The right to be elected, as a staff member, as governing partners is subject to uninterrupted membership in the relevant category for five years, without prejudice to the special requisites of higher seniority that is contained within these statutes...
Article 21
Members have the duties to/of: a) Honour the Club and defend its name and prestige; b) Pay quotas and other contributions that accord with statutory requirements; c) To fulfil punctually ('cumprir pontualmente') the dispositions of the statutes and regulations of the Club, and to act on the deliberations and decisions of the governing bodies they belong to; d) To congregate only under the terms and conditions established in these present statutes; e) To accept those offices that are elected or named and to do so in exemplary moral and civil conduct, in conformity with guidelines established by the governing bodies of the Club; f) To ensure the internal cohesion of the Club; g) To maintain impeccable moral behaviour and discipline in a way as to so not prejudice the legitimate interests of SPORTING CLUBE DE PORTUGAL, including defending and ensuring the assets of the Club; h) To maintain, until the respective General Assembly, the confidentiality of information obtained under d) of provision 1 of Article 20, respecting, in any case, the provisions of a) and f) of the present article; i) To communicate to the Board ('Conselho Directivo') a change of residence no later than sixty days after its occurrence.
Article 22
1- The amounts and conditions to satisfy for each member category, including new member joining fees, are to be fixed by the General Assembly on proposal of the board. 2- With respect to the procedures set out in the previous provision, various levels of quotas may exist, with members choosing the level at which they integrate; the payment of different quotas does not correspond to differences in rights. 3- The Board ('Conselho Directivo') may, in each year, establish periods of exception of new member entrance fees and, like this, proceed with the reduction or temporary exception of quota amounts. 4- Members with more than twenty years of uninterrupted membership of SPORTING CLUBE DE PORTUGAL, that prove that their professional activities do not exceed an amount fixed annually by the Board, may be eligible for exception of payments, in total or in part, of the respective quota; the Board is responsible for the assessment of applications in this sense and also the final decision of the exception. 5- Quotas are considered payable in the first day of the respective month and ought to be settled in the same period.
Section III - Honorary distinctions and awards
Article 23
With the primary objective of awarding and/or distinguishing exceptional service in dedication to, and the associated merit or contribution to the growth of, the Club is divided into the following Honorary distinctions; a) Golden Lion with Palm leaf; b) Golden Lion; c) Silver Lion; d) Medal of Merit and Dedication; e) Special emblem.
Article 24
1 - In addition to the honorary distinctions referred to in the previous provision, there can also be attributed the award of honorary member, deserving and of merit. 2- The attributing of members of the Golden Lion with Palm leaf confers, simultaneously, to the diploma of honorary member and the attributing of the Golden Lion and diploma of member of merit. 3- Benefactor ('benemérito') members are those that have of received numerous previous awards, namely for donations or other helpful actions, or that have been creditors of recognition of the Club. 4- The diploma of honorary member and of benefactor member can be granted to deserving individuals of exemplary moral and civic behaviour or collectives of persons estranged to the Club, with the dispensation of the payment of associated contributions or sport.
Article 25
1- The attributing of honorary distinctions referred to in the provisions a) and c) of article 23 is the responsibility of the General Assembly, upon proposal by the Board or by 250 staff members with more than ten years of subscription.
Article 26
1 - The honorary distinctions referred to in the provisions d) and e) of article 23 are according to the following regime: a) The medal of Merit and Dedication distinguishes members who have demonstrated exemplary devotion to the Club; b) The Special Emblem, surrounded by a crown of bay leaves, is to be attributed respectively: - of silver, to the members with twenty five years of uninterrupted subscription; - of silver gilt, to the members with fifty years of uninterrupted subscription; - of radiant silver gilt, to the members with seventy five years of uninterrupted subscription.
Article 27
1- The attribution of honorary distinctions of the provisions d) and e) in articles 23 of the awards mentioned in article 24 are at the discretion of the Board. 2- The delivery of each distinction or award will be accompanied by the explanations of the determining reasons for its choice. 3- Distinctions and awards can be attributed as posthumous titles..
Article 28
1- In appropriate locations at Estádio José Alvalade, or other installations of the Club, the names will be inscribed of those that represented the club with services of distinction that are worthy of consideration, as approved by the General Assembly. 2- The Board defines the regulations and specific conditions that ought to be followed in the attributing of honorary distinctions and the norms and technical characteristics of the models for awarding diplomas and awards.
Section IV - Disciplinary Sanctions
Article 29
1 - Members are punishable by disciplinary measures in committing any of the following infractions: a) Disrespecting the statutes, internal regulations of the Club or deliberations of governing bodies; b) Slander, defame or offend the governing bodies of the Club or whatever respective members, during or because of the exercise of their duties; c) Pronounce expressions or commit acts, inside or outside the installations of the Club, that are offensive to the morality of the public; d) Attempt against, prejudice or in whatever form impede the normal and legitimate exercise of the functions of the governing bodies of the Club. 2- The applicable sanctions, in conformity with the seriousness of the infringement, are as follows: a) Warning; b) Registered reprehension; c) Temporary suspension; d) Expulsion. 3- Sanctions ought to be applied most stringently when infractions have been committed by members of governing bodies, with cases of expulsion or temporary suspension greater than sixty days in duration resulting in the immediate lose of office. 4- The Fiscal and Disciplinary Council in the taking or organising of whatever disciplinary process, after due deliberation of what sanctions are to be applied, should take into account the provisions of these statutes and the internal regulations, rules and legislation that is applicable; no deliberation about the application of sanctions can take place without the defendant having been heard. 5- The application of whichever of the sanctions in the provisions c) and d) of number 2 of this article can be appealed to the General assembly, with effect of revision in the case of provision c) and with the effect of reinstatement in the case provision d). Such actions are to be brought within thirty days of the notification of the suspension that is to be applied. 6- Temporary suspension cannot exceed the duration of one year. 7- The exclusion of a member, for motive of not having paid quotas for a period superior to six months, and not having the attitude to inform the Club in writing of the reasons for such actions, does not constitute as a disciplinary sanction, but as an administrative action that can be completed by the general competency of the Board.
Article 30
1 - No member may transfer their respective card of association to another, lest it be seized, independently of the eventual sanctions that may be brought about by the anterior article. 2- In cases of reincidence, the penalty applicable is obligated to be that in provision d) of number 2 of the anterior article.
Section V - Readmission of Members
Article 31
1 - Members may be reinstated into the member framework Club, and the previous associated area, are: a) Those dismissed at their request; b) Those excluded for reasons of not paying quotas; c) Those expulsions, driven by the disciplinary process, when the general assembly is expressly convened for that purpose, approves the readmission with a two-thirds majority, and with the favourable opinion of the Conselho Leonino. 2- The member dismissed by their own request has the faculty to request the maintenance of their member number at the time of their dismissal, assuming the paying of all relative quotas relative to the period of absence, always calculated respective to quotas due for the relative category of member and the date of readmission, other than when stated to the contrary by the Board. 3- The member excluded for reasons of not paying quotas may be readmitted if, in the act of readmission, pays all quotas indebted, as relative to the anterior provision, but with the added value of a new entry fee (joía) on the date of readmission. 4- If the number of the member referred to in the previous provision cannot be reallocated because of its relocation to another member, the next available proceeding member plus a letter is to be issued until the next reassessment of numbers relative to seniority. 5- The consideration of subscription as uninterrupted is in consideration of the numbers 2 and 3. |  |
